Community Guidelines

Show respect to all Oshinstar users and communities. One of the benefits of Oshinstar is that it manages to bring together different types of people and companies through their different interests and creativity, making very different communities flourish on the platform.

We want Oshinstar to be a friendly and safe place for talents, businesses and communities of all kinds.

How we enforce these standards

Please note that Oshinstar is a diverse community, and while you may not entirely agree with some people's views, they may not be in violation of our community guidelines. That said, when you see a profile on Oshinstar that you think violates our community standards, please report it to us through our reporting tool. Here's more information on how to report a Talent or content.

A member of the Oshinstar Security team will review the report and, if our community standards have been violated, the case manager will contact the Talent to follow up.

This is a commitment to the Talents. We go to great lengths to make these types of decisions as fair and transparent as possible.

We want Talents to trust us and feel that they can communicate any situation to us at any time. We will always try to explain to Talents why they have violated the rules and how to fix the problem. In cases where the violation is particularly serious or intentional, we may take additional measures, such as suspending or deleting the account. In the most extreme cases, we may ban the Talent from using Oshinstar.

When we review a profile, we pay attention to how the Talent handles their profile: their personal and professional information, content, links and fans. In any case, we always give Talents the opportunity to appeal decisions by contacting us and sending us any relevant information they feel has been overlooked.

Connect, respect others and express your creativity

These Community Standards serve to guide and shape Oshinstar and the growing number of Talents and communities that use it. They are not intended to create an arbitrary framework of what is "right" or "wrong". The aim is for Oshinstar to become a place where all Talents and their communities can be proud of, where they feel supported and can express their enthusiasm, and where different, though sometimes conflicting, points of view can come together.

These standards summarize our internal policy, helping all Talents to achieve a safe and supportive environment, connecting, creating, sharing and building close and lasting relationships with all communities.

Authenticity

In short, Oshinstar is the ideal place for Talents who bring something original to the world. As a Talent, you may not make posts that infringe on other people's intellectual property rights.

  • You cannot create fake profiles. For example, you may not create a fan page for someone else.

  • You may not impersonate another user or impersonate another person by using their name, brand, or works to mislead fans or community.

  • You are not allowed to use Oshinstar as a joke or to fund anything other than artistic activity.

Bullying, Harassment and Threats

We do not allow bullying, harassment and threats in the community. We want Oshinstar to remain a safe place for all our talents, companies, fans and users in general.

We are very strict when it comes to harassment or any action that may affect the physical integrity of any person, talent or company.

As much as we want you to express yourself freely, we also want the whole community to be able to give their opinion without feeling intimidated. Here's how we define these behaviors:

Bullying and harassment:

You must not bully anyone, either directly or by using your influence or the influence of others. We tend to take real-life interactions more seriously than online interactions, because certain threatening behaviors can lead to physical violence.

Threats:

Anyone at Oshinstar should be able to express their opinion without threatening others. In this regard, we take threats of violence very seriously. We will remove from the platform any profile that threatens the well-being of an individual or group of people. This includes threatening behavior such as stalking or inciting others to commit violent acts.

If you are a victim of this behavior and feel you are in danger, we encourage you to report it to the authorities and to inform us of the situation.

Hate Speech

Oshinstar is a global platform that connects talents with fans from all over the world, created to empower and encourage creativity, which makes us a very inclusive group. Therefore, there is no place on Oshinstar for projects that fund hate speech, such as incitement to violence, exclusion or segregation. This includes serious attacks on people based on race, ethnicity, country of origin, religion, sex, gender, sexual orientation, age, disability or serious medical conditions.

When we review an account for a possible hate speech violation, we consider some of the following questions:

  • Do the creative works have any historical or educational value?

  • Is violence incited against anyone for touching on historical topics such as Dictatorships?

  • Does the Talent glorify a group known to support ideologies that would be classified as hate speech under this policy?

  • Does the Talent use racial slurs or negative portrayals of someone based on a characteristic such as those listed above?

This list is not exhaustive, but we want to be transparent about how we work in the gray areas between speech and action. The line between political opinion and hate speech can be very thin. If you find any content on Oshinstar that you think could be considered hate speech, we ask that you report it.

Creative works for seniors

We are striving to create a community that is inclusive and diverse, so we want to take into account the ages and sensibilities of our users. We are not trying to create or enforce arbitrary frameworks of what is "right" or "wrong," but rather to give people the choice of whether or not to view adult creations.

To help fans make these decisions, we mark adult content as "age-appropriate" to differentiate it from content suitable for all audiences.

We define "mature content" as any audio, visual or audiovisual creation that depicts sexually explicit situations, including nudity in sexual contexts (more information on nudity below).

We ask Talents to mark their profile as PG if their work may be considered inappropriate for minors. We know that the exact age of majority can change depending on where you are, but in most places a certain level of maturity is required to view this type of creative work and participate in these activities. Here are some examples as a guideline.

Examples of content that we consider suitable only for adults:

  • Creations depicting real nude people in sexual contexts.

  • Animations or illustrations depicting nudity in sexual contexts, and animations or illustrations depicting sexual interactions.

  • Audio content that reproduces simulated sexual interactions.

Examples of content that we do not consider suitable only for those of legal age:

  • Creations with nudity that are not designed to be sexually gratifying, such as photos of sculptures or paintings.

  • Creations with nudity or sexual situations designed for educational purposes.

We ask all Talents that their profile pictures, bibliographies, cover photos, etc. be suitable for all audiences. Adult-only content should be reserved for fan-only posts.

Nudes

On Oshinstar you can post nude creations with both real and fictional themes. Just be sure to mark posts with adult-only content as "For Fans Only" and make sure your page is marked as adult-only if your content is going to feature such themes.

Never post or share nude artwork of any underage person, even if it is your own. As we are committed to keeping children safe on our platform, we will cooperate with law enforcement whenever we find child exploitation material. You can read more about our Benefit Guidelines in the following section.

Finally, we understand that some Talents may have both mature and mainstream works, which is also fine. We will always evaluate your work with context in mind. However, if you have questions about posting both types of content at the same time, you can refer to our Benefit Guidelines.

Pornography and sexual services

We do not allow pornographic material or sexual services on Oshinstar. We define this as "real people engaging in acts of sexual content such as masturbation or sexual intercourse in front of a camera". For more information, you can also refer to our Benefit Guidelines.

Graphic and offensive creations

We understand that artists sometimes have to push boundaries to create thought-provoking art, so we are not strict in reviewing graphic and offensive works. We take into account the context of the entire Talent page.

However, we have zero tolerance when there is apology for sexual violence, such as zoophilia, rape and child exploitation, i.e. sexualized representation of minors. This applies to any type of work, including illustrations or animations. Oshinstar reserves the right to review and delete accounts that may violate this rule.

We also do not allow other works related to fringe sexual tendencies, such as incest, necrophilia, or fetish work where it is not clear that the sexual act is consensual.

Also, we understand that some of the topics on this list, such as incest or rape, are a bit more complicated because, unfortunately, they are part of real life. Therefore, when reviewing these types of works, the Oshinstar Security team will take the context into consideration, taking into account personal, historical or educational background.

Doxing

We take a strong stance against doxing, which involves sharing a person's private information or collecting their public information in order to intimidate them.

We take this strong stance against doxing because it is used to silence or intimidate people with different views on the Internet. It can cause deep emotional trauma and put the victim's physical integrity at risk.

The most common form of doxing involves sharing a person's private personal information. This information can be their phone number or address. The definition of private personal information can vary and, basically, it may be data that is very difficult to find.

It is also considered doxing when non-private information about a person is collected. For example, combining someone's profile picture along with their real name, the city they live in and all of their known social media accounts could be considered a form of doxing.

Regardless of the specific information that was shared, we consider the context and for what purpose it was shared. If it appears to have been intended to make it easier for a large group of people to harass that person, we would likely consider it doxing.

In cases of doxing, we lose the ability to have conversations. Doxing is not a dialogue that counterargues another, it is a dialogue that prevents others from speaking. It makes it impossible for us to discuss ideas, to grow as individuals, and to have a safe space to disagree.

Who may not use Oshinstar

At Oshinstar we support all artists and professionals in the art industry, as well as related companies.

We may ban from using the Oshinstar platform any user, talent or company that we catch in the act or is suspected of making credible violent threats, committing violent crimes, engaging in malicious doxing, coordinating non-violent harm (such as fraud, money laundering and gambling) or encouraging others to engage in any of these activities.

Political

The use of Oshinstar for political purposes, such as to finance a candidacy, public office or to finance other people's political campaigns, is not permitted.

Criminal or Harmful Records

Individuals with a criminal record who have served their sentence may share their work on Oshinstar. Any user we catch in the act or who has been convicted of making credible violent threats, committing violent crimes, child abuse, malicious doxing, coordinating non-violent harm (such as fraud, money laundering and gambling), or encouraging others to engage in any of these activities may be banned from using the Oshinstar site.

Dangerous Organizations

IIndividuals with a known affiliation with violent or dangerous groups (including terrorist or cyber-terrorist organizations, organized criminal groups, and violent hate groups) may not receive funds through Oshinstar.

Talent may discuss these groups in their content as long as it is for educational, informational or debunking purposes. However, actively supporting these groups or their leaders through Oshinstar may result in account deletion.

Harmful and Illegal Activities

We do not allow fundraising for any harmful or illegal activity. It is not allowed to fund creative works that advocate, threaten or show Oshinstar users harming themselves, other people or animals. It is also not allowed to promote illegal activities such as crimes against private property, distribution of illegal weapons or drug manufacturing. We allow street art.

When we speak of street art or urban art, we refer to informal techniques of artistic expression that occur in the streets in a free manner, without resorting to vandalism or other forms of illegal intervention of the public facade of the cities.

Self-harm

It is not permitted to promote self-harm, such as profiles that encourage physical self-harm, suicide or eating disorders. Examples include pages glorifying self-flagellation or campaigning for anorexia. If we believe there is a plausible risk that a user will engage in self-harm, we will cooperate with the authorities when necessary. However, we do allow creations that promote awareness, such as stories of people who survived self-injury, especially if they have pedagogical value.

Illegal activities

We do not allow profiles that raise money for an illegal purpose or that encourage others to break the law. For example, Talents may not promote illegal weapons, drug manufacturing or distribution techniques, or property crimes. However, we review each case individually. For example, we do not allow works that help organize or encourage vandalism.

Dangerous activities

We ask talents who post dangerous stunts to include a clear disclaimer. We also require that such postings be marked "For Promoters Only" if they are too graphic or dangerous for the general public.

Child Safety

Oshinstar has zero tolerance for behavior that exploits minors, such as grooming. We will remove users from Oshinstar who actively facilitate the exploitation or attempt to exploit minors in this manner. We will report all users who engage in such activity to legal authorities upon removal.

Disinformation

Oshinstar will not help fund creations that engage in medical disinformation related to Covid-19 and disinformation related to the propagation of conspiracy theories.

Spam

We know that growing your fan community is not an easy task. So we encourage you to use your creativity and originality. Do not spam by posting repetitive comments or send unwanted private messages to other members of the community.

Some of the actions considered spamming are prohibited on Oshinstar

  • Do not create pledge schemes; do not contact other talents to enter into a pledge-for-pledge type of business arrangement.

  • Do not use Oshinstar to launch or link to malware or phishing schemes.

  • Do not make misleading posts to increase your fan base.

  • Do not post comments on other talents' profiles that promote your own profile.

  • Do not send a large number of unsolicited private messages asking for help.

When reviewing spam reports, we will make a distinction between commercial spam and friendly abuse, such as legitimate talents spamming other talents' profiles. If we consider spam to be friendly abuse, we will give you a warning; if there is a repeat offense, we will remove the talent or fan page entirely. We will remove commercial spam from a profile that is not from a legitimate talent from Oshinstar.

No one likes to receive spam attacks, so bring out your creativity and originality.

Fan Accounts

The essence of the Community Guidelines applies to both Talents and general Oshinstar users. While we allow Talents to manage their communities, on occasion the Oshinstar Security team will review complaints about fan behavior.

The Oshinstar Security team will carefully review reports of hate speech, harassment and grooming, and we will take appropriate action against a fan's account if it violates these rules.

Talent can report fan posts directly by following these instructions. Please note that we maintain the confidentiality of these reviews. Most importantly, if you feel insecure because a fan is stalking or harassing you, you should always contact us, ask for help from the police and/or contact the nearest cybercrime unit, as they have the most resources and means to deal with this situation. Oshinstar will cooperate closely with the police when there is an investigation and if we receive a subpoena.

Financial advice content

Because Oshinstar values the safety of talent and fans alike, we encourage consumers of financial advisory content to consult with licensed financial professionals before making investment decisions.

Disallowed Charges

Chargebacks are initiated when individuals or, in Oshinstar's case, fans, contact their financial institutions to dispute a transaction. To protect talent, Oshinstar will review excessive and potentially fraudulent chargebacks and may prevent fans from subscribing to other talent for the duration of that review. If a fan's rejected charges are determined to be fraudulent, Oshinstar reserves the right to suspend or delete their account. You can find more information about declined charges here.
